DMCA & Copyright Policy

Noir respects intellectual property rights and responds to valid copyright infringement notices in accordance with the Digital Millennium Copyright Act and applicable international law.

1. Our Commitment to Copyright Protection

Noir respects the intellectual property rights of third parties and expects users of the Platform to do the same. We will respond promptly to valid notices of copyright infringement in accordance with the provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent international legislation.

We operate a repeat infringer policy: accounts that repeatedly infringe third-party copyright will be permanently terminated.

2. Submitting a DMCA Takedown Notice

If you believe that content on the Noir Platform infringes your copyright, please submit a written takedown notice to our designated DMCA Agent containing the following:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material on our Platform that you claim is infringing, with sufficient detail for us to locate it (e.g., URL, profile identifier).
  • Your contact information: full legal name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
  • Your electronic or physical signature.

We will process valid takedown notices within 5 business days. If expedited processing is required due to ongoing harm, please indicate this clearly in your submission.

3. Counter-Notification

If you believe that content removed in response to a DMCA notice was removed in error or misidentification, you may submit a counter-notification to our DMCA Agent containing:

  • Identification of the specific content that was removed and its previous location on the Platform.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your full name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of an appropriate federal court and will accept service of process from the original complainant.
  • Your electronic or physical signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant files a legal action seeking a court order.

4. Non-DMCA Content Removal

For content removal requests not based on copyright grounds (e.g., privacy violations, defamation, or identity concerns), please refer to our Content Removal Policy.

5. Misuse of DMCA Process

Filing a false or fraudulent DMCA notice is a federal crime under 17 U.S.C. § 512(f), which provides for penalties including damages, attorney's fees, and other remedies. We reserve the right to seek such remedies from parties who submit bad-faith notices.

6. Platform Intellectual Property

All content, software, design, branding, and materials comprising the Noir Platform are owned by or licensed to Noir and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without express written permission.
